New Delhi. In Haryana, Punjab and Chandigarh, wearing a helmet has now been made mandatory for every bike rider above 4 years of age. The Punjab and Haryana High Court has given clear instructions that the helmet should be as per the standards set by the Central Government.
The bench of Punjab and Haryana High Court Chief Justice Sheel Nagu and Justice Anil Kshetrapal issued orders in this regard on October 29, which have now become public.
Sikhs will get special exemption
Under this order, only those Sikh women and men who are wearing turban will be exempted from helmet. The High Court has also directed Haryana, Punjab and Chandigarh Police to present the records of challans of women riding bikes without helmets and pillion riders. The next hearing of this case will be on December 4.
Rules will apply to children older than 4 years
The High Court has clarified in its instructions that these rules will apply to all persons above 4 years of age, whether they are riding the bike, sitting on the pillion or being carried on the bike. Children have also been included in this. It will be mandatory to follow this order on every type of bike, irrespective of the type of bike. However, if a Sikh person is wearing a turban while riding or sitting on a bike, he will be exempted from wearing a helmet.
Instructions for making safety rules for small children
The High Court has also asked the Central Government to make special rules for the safety of children below 4 years of age riding two-wheelers. The court has also directed that the quality of the helmet should be such that it provides adequate protection to the head in case of an accident. Apart from this, the helmet should not only be placed on the head, but it should also be tied securely.
