What is the matter?
The incident is of 7 February 2015. The victim, Prabhu Dayal, son of Ram Harak Kori, resident of Belikhurd, had lodged a complaint at Tulsipur police station that the four accused – Shankar Nath Dubey, Naga alias Nagmani, Sidhnath Dubey, and Karike alias Indramani, had cut down three of his rosewood trees by theft. When she protested, the accused used caste-related words, abused and assaulted her.
Registration and Investigation
On the complaint of the plaintiff, a case was registered in Tulsipur police station under case number 148/15 under sections 379, 323, 504, 506 and 3(1)(X) of SC/ST Act and Uttar Pradesh Bridge Preservation Act. After investigating the case, the police filed the charge sheet against the accused in the court.
Cases went on in the court for 9 years
During the trial, both sides presented witnesses and evidence in court. On the basis of these testimonies and evidence, the court found all four accused guilty. The court said that the accused were found involved in the crimes of theft, caste-based abuse and assault.
The court sentenced all four accused to three years’ imprisonment and a fine of Rs 4,000 each. Non-payment of fine will result in additional punishment.
