Hearing will be held today in the Supreme Court on the Shri Krishna Janmabhoomi and Shahi Idgah dispute in Mathura. The bench of Chief Justice Sanjeev Khanna and Justice Sanjay Kumar will hear the petition of the Muslim side. In the petition, the Muslim side has demanded that 18 petitions of the Hindu side be heard.
.
The hearing on the petition was scheduled for November 29. During this, Chief Justice Sanjeev Khanna had said – We have to decide what is the legal status of the case. We feel that the decision of the single bench of the High Court can be appealed in the inter court i.e. double bench.
In fact, Allahabad High Court had rejected the petition of the Muslim side on August 1. The High Court had said that 18 petitions filed by the Hindu side will be heard together.
Read the arguments of Hindu and Muslim sides…Hindu In the petitions filed by the parties, it has been claimed that the two and a half acre area of Shahi Idgah is not a mosque. That is the sanctum sanctorum of Shri Krishna’s birthplace. All the petitions are of the same nature. Therefore let us be heard together.
Muslim The party has argued that space for the mosque was given under the agreement signed in 1968. It is not right to call the agreement wrong after 60 years. Therefore the petitions of the Hindu side are not maintainable.
What is the whole controversy? This entire dispute is regarding the ownership rights of 13.37 acres of land. There is Shri Krishna Temple on 11 acres of land and 2.37 acres is near Shahi Idgah Mosque. The Hindu side has been claiming this 2.37 acre land as its birthplace. The Shahi Idgah Mosque was built here in 1670 during the rule of Aurangzeb.
In 1944, this entire land was purchased by industrialist Jugal Kishore Birla. In 1951, he formed the Shri Krishna Janmasthan Trust, to which this land was given. The temple was rebuilt afresh in 1958 with the money of the trust. Then a new institution was formed, which was named Shri Krishna Janmasthan Seva Sansthan. This organization made an agreement with the Muslim side in the year 1968 that both temple and mosque would remain on the land. However, this agreement never had a legal existence nor did the Shri Krishna Janmasthan Trust ever accept this agreement.
The Hindu side now demands the removal of this mosque, while the Muslim side argues for the Places of Worship Act.
